My deposit is not protected, and the landlord wants to keep it?

My landlord took a £300 deposit from, for a 12 month fixed term tenancy, and told me it was going to a tenancy deposit protection scheme.


I have contacted all 3 schemes, TDS, DPS and mydeposits.co.uk, they do not have my deposit.


I still have a couple of weeks left before the end of my tenancy, but the landlord has already said he wants to hold back some of it due to damage to the laminate flooring - which I would consider general wear and tear ( a couple of scuff marks that just won't polish out ).




Since my deposit isn't protected, and we disagree about what he should be keeping, do we have to go to court to get them to decide the right amount? Does he get punished for not protecting it, and lying to me? Does he have any right to keep an amount he decides, if it isn't protected?


My landlord has been very dodgy from the start, and is currently being taken to court for letting unlicensed HMO's (including mine), for which we have been told he may have to pay us a percentage of the years rent back to us if prosecuted. He's been told to be nice to us by his solicitor, but I think he's trying to squeeze money out of our deposits because he's going to get fined for these HMO's.


Anyone got any advice? I contacted all 3 agencies to double check, and they've never heard of the landlord, or anyone our address.
@kemperk: Hah, thanks for the advice :P There are actually specific laws for protecting deposits, but I can't see much on whether, if not protected, I'm guaranteed to get the full amount? Then I read stories of being paid 3x the amount in compensation, which seems a little extreme - but I read the relevant chapters in the 2004 Housing Act and it seems to be the case.

Does anyone else know, in regards to him not protecting the deposits, even if he offers the full amount - do we have a case against him for not protecting it anyway?
